Designated agent
Send copyright notices and counter-notices to the designated agent. The bracketed lines are placeholders until the operator registers the agent with the U.S. Copyright Office and replaces them.
[Designated agent name]Fauxtina[Street address, city, state, ZIP, country][dmca@fauxtina.com][Telephone number]Takedown notice
A notice under 17 U.S.C. § 512(c)(3) must include all of the following. A notice that leaves one out may not be acted on.
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if many works are covered by one notice, a representative list of those works.
- Identification of the material that is claimed to be infringing, and information reasonably sufficient to let us find it, such as the URL of the post.
- Information reasonably sufficient to contact you, including an address, telephone number, and email address.
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
What we do with a notice
If the notice is complete, we remove or disable access to the material and tell the member who posted it. That removal can be recorded as a copyright strike. Repeat infringers can have their accounts terminated, as described in the Terms of Service.
Counter-notice
If your material was removed because of a takedown notice and you believe that was a mistake or misidentification, you may send a counter-notice to the designated agent. It must include:
- Your physical or electronic signature.
- Identification of the material that was removed, and the location where it appeared before it was removed, such as the URL.
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located or, if your address is outside the United States, for any judicial district in which Fauxtina may be found, and that you will accept service of process from the person who sent the original notice or that person's agent.
After we receive a valid counter-notice, we may forward it to the person who sent the takedown. If that person does not notify us that they have filed a court action seeking to restrain the member, we may restore the material in the time the statute describes, generally 10 to 14 business days.
